Photography terms of sale
Information about booking, producing and delivering a photography shoot.
These terms are being finalised. The details and price of your service are set out in the quote provided before booking.
Scope and quote
These terms cover photography services offered by Tanguy Dessoly to consumers and businesses. A request submitted on the website is neither a booking nor an order.
Each service receives a prior quote describing the project, people involved, location, date or schedule, number of delivered images, included retouching, delivery time, total price and any travel or collaborator costs. The order is confirmed after written acceptance of the quote and these terms; specific terms in the quote prevail where they add detail.
Price and deposit
The price and VAT treatment are stated in the quote. No price is calculated or paid automatically on the website.
A deposit (acompte) of 40% of the total price is requested after the quote is accepted, under a separate invoice or payment request. It is the first instalment of the price, not a cancellation fee or ‘arrhes’. The balance and due date appear in the quote, normally before final delivery. Extra costs require prior agreement.
Consumers’ withdrawal rights
When a consumer contract is concluded remotely or away from business premises, the statutory withdrawal right applies under French consumer law, generally for 14 days. The quote or contract must provide the required information and withdrawal form.
If the consumer expressly asks for work to begin before that period ends, this request is collected separately; if they then withdraw, the work already carried out may be payable under applicable rules. Paying the deposit or sending a brief does not in itself waive withdrawal rights.
Rescheduling, cancellation and weather
Please request any rescheduling or cancellation in writing as soon as possible. A mutually agreed new date is sought first; any non-refundable external bookings are detailed in the quote where relevant.
If the client cancels outside a statutory withdrawal right, work already done and documented, unrecoverable costs may be taken into account. The deposit is offset against amounts actually due and any excess is refunded. If the photographer cancels without an agreed new date, payments for the unperformed service are refunded.
Weather that makes an outdoor project impractical leads to a joint decision to reschedule or adapt the location and direction. Weather that merely differs from the hoped-for mood does not automatically cancel the shoot; the quote may set a specific threshold or fallback plan.
Session, lateness and delivery
Participants should arrive on time and report delays promptly. Client lateness may shorten the shoot where the venue or other commitments prevent an extension. If the photographer is late, time is made up where possible or a proportionate solution is agreed.
The selection, file format, image count and delivery method are set out in the quote. The usual estimate shown on the website is about one week after selection, but only the date confirmed in the quote binds the parties. RAW files are not included unless expressly agreed. Clients should keep a copy of delivered files after download.
Retouching and revisions
The service includes the corrections and retouching expressly described in the quote. One consolidated request for light corrections to delivered images may be made within seven days of delivery; it concerns alignment with the agreed result, not a new artistic direction. Major changes, extra images or a different direction require a new quote before work begins.
Usage rights and image rights
The photographer retains copyright in the images. Delivering files does not transfer that copyright. The quote or a separate licence defines permitted uses precisely: purpose, media, territory, duration, exclusivity, permitted adaptations and any fee. Without agreed business use, images delivered to a private client are for personal use, excluding resale and advertising.
Permission to publish an identifiable person’s likeness is separate from the quote, copyright licence and form privacy information. Publication on the portfolio, social media or in a campaign is never assumed. Each person concerned must be informed of the proposed uses and give appropriate permission before publication. This website does not currently offer projects involving minors.
Complaints
Please report a difficulty in writing to tanguy@dessoly.com so an amicable solution can be sought.
Statutory consumer rights continue to apply regardless of these terms or the quote.
